This case was assigned to us, as this is a landmark case on Sec. 23 of the Negotiable Instruments Law. [GR No. 107382]

Sec. 23. FORGED SIGNATURE, EFFECT OF: - When a signature is forged or made without authority of the person whose signature it purports to be, it is wholly inoperative, and no right to retain the instrument, or to give a discharge therefor, or to enforce payment thereof against any party thereto, can be acquired through or under such signature unless the party against whom it it sought to enforces such right is precluded from setting up the forgery or want of authority.

Well, the case talks about forgery, in our assigned readings there were 30 checks that were involved, checks which were forged and delivered. These checks were allocated by the province of Tarlac to Concepcion Emergency Hospital. Upon audit, it was discovered that the hospital did not receive the said checks.

Fausto Pangilinan (retired: February 28, 1978), was the administrative officer and cashier of payee hospital, collected the questioned checks from the office of the Provincial Treasurer. He claimed to be assisting or helping the hospital. Pangilinan had forged Dr. Adena Canlas' signature who was the chief of the payee hospital for the checks he had encashed, with the last check dated February 10, 1981.
